Tax rates can vary depending on the municipality, property owner, buyer or individual subject matter.


Please ensure that the costs and taxes incurred are certified by a notary. It is also negotiated beforehand who has to bear the individual costs and taxes. It is therefore advisable for both parties to consult a lawyer. Also due to the different laws and taxes within the Balearic Islands and municipalities, it is always advisable to seek legal advice. The fees are currently between 1% and 1.5%.


The real estate transfer tax "ITP" is graded according to the sales price. It is between 8% and 13%. In addition, there is the market value "AJS", here a further tax of 1.5% of the notarized value is levied.


It must also be taken into account whether the seller is a property developer, the property is a first sale (then VAT) and whether it is a private person or an S.L: (comparable to a GmbH). The commercial use of the property then also plays a role in taxation.


One-time costs when purchasing real estate arise from notary and register entries. From 01/01/2020, 1.5% will be charged for certificates.


The property tax "Impuestos Bienes Inmuebles". It is usually to be paid by the owners and is determined by the respective municipality on the basis of the cadastral value of the property. The rate is between 0.3% and 0.4% of the cadastral value.


The community's capital gains tax, the “plusvalia”, must also be paid. This tax is based exclusively on the increase in value of the land and varies depending on the municipality. Rural properties that are classified as "rustico" are an exception.
